Alaska Board of Fisheries to Meet in Anchorage, February 26-March 4, 2013

 

The Alaska Board of Fisheries (board) will meet February 26-March 4, 2013, at the Sheraton Hotel, 401 East 6th Avenue, Anchorage, Alaska. During this seven-day public meeting, the board will consider 48 proposals regarding Alaska Peninsula/Aleutian Islands finfish issues that have been submitted by the general public, fishing organizations, local Fish and Game Advisory Committees, and the Alaska Department of Fish and Game.

 

In addition to submitting written public comments, the board also invites members of the public to give oral public testimony during the meeting beginning February 26. Any person intending to testify must sign up at the meeting site at the Sheraton Hotel in Anchorage by 10:00 a.m. Wednesday, February 27. Public testimony will continue until members of the public who have signed up before the deadline and who are present have been given an opportunity to testify.

 

All portions of the meeting are open to the public and a live audio stream is intended to be available on the Board of Fisheries’ website at www.boardoffisheries.adfg.alaska.gov. Documents submitted to the board are intended to be posted online throughout the meeting. Copies of advanced meeting materials including the agenda and roadmap can be obtained by contacting Boards Support Section at 907-465-4110 or viewed online at:  http://www.adfg.alaska.gov/index.cfm?adfg=fisheriesboard.meetinginfo.

 

The board encourages the public to submit written comments on specific proposals. Written public comments limited to 10 single-sided or 5 double-sided pages in length from any one individual or group will be accepted as a record copy (RC), but will not be inserted in board member workbooks until the beginning of the meeting, and will only be accepted until the board begins deliberation of proposals.

 

NEW PUBLIC COMMENT STANDARD:  Once deliberation of proposals begin at a board meeting, the board will ONLY accept written public comments that are not more than five single-sided pages, or the equivalent double-sided pages, unless specific information is requested by the board that requires more pages than allowed under this standard.

 

During the meeting, written public comments from any one individual or group may be submitted by hand delivery at any time if 25 copies are provided; as a practical matter, comments submitted after the board begins deliberations on relevant proposals are likely to receive less consideration than comments submitted earlier. NOTICE OF PUBLIC MEETING OF THE
ALASKA BOARD OF FISHERIES’ UPPER COOK INLET TASK FORCE

 

The Upper Cook Inlet Task Force of the Board of Fisheries (Board) will meet from 9:00 a.m. to 5:00 p.m., Thursday, February 14, 2013, at the Challenger Learning Center, 9711 Kenai Spur Highway, Kenai, Alaska. 

 

The Board established the Task Force to evaluate options for possible changes to the Kenai River Late-Run King Salmon Management Plan and associated Upper Cook Inlet salmon fisheries regulations.  This Task Force is made up of two Board members (who serve as co-chairs of the Task Force), three Upper Subdistrict set gillnet fishers, one drift gillnet fisher, two sports fishers, one sports guide, one personal use (dip net) fisher, and one marine recreation member.

 

The Task Force Mission and Organization Statement and any additional information regarding the Task Force is located on the Board of Fisheries website at: http://www.adfg.alaska.gov/index.cfm?adfg=fisheriesboard.taskforce

 

No regulatory action will be taken at this meeting.  It is intended that parliamentary procedures for Task Force work will follow the “New England Town Meeting” style, and that Task Force co-chairs will manage the meeting in a manner that encourages open and respectful exchange of information and ideas, seeking to achieve resolution of misunderstandings and consensus solutions where possible. 

 

After the Task Force has completed the work from this meeting a written summary will be prepared to capture and summarize the general discussion and any recommendations of the Task Force, which will then be made available to the public.

 

Agenda topics for this meeting will include but not be limited to: continuing discussion on management strategies when the Alaska Department of Fish and Game projects abundance below escapement goals of the Kenai River Late-Run King salmon fishery.

This is a SUPPLEMENTAL NOTICE adding to the NOTICE OF PROPOSED CHANGES that was issued on November 2, 2012, hereby incorporated by reference, concerning proposed regulation changes in Title 5 of the Alaska Administrative Code.  This SUPPLEMENTAL NOTICE is being issued to notify the public of the following topic being added to the Board of Fisheries (board) schedule to be considered at the meeting noted:

PROPOSAL 250 - 5 AAC 06.331.  Gillnet specifications and operations.  For the Ugashik and Egegik districts, establish provisions to allow a person who holds two Bristol Bay CFEC set gillnet permits to "stack" those permits and operate extra gillnet gear within certain gear specifications, including length of gear and gear marking requirements, as follows:

 

5 AAC 06.331 is amended by adding a new subsection to read:

(v)  In the Ugashik and Egegik Districts, a CFEC permit holder who holds two Bristol Bay set gillnet permits may not operate more than four set gillnets, and the aggregate length of set gillnets operated by the CFEC permit holder may not exceed 100 fathoms.  A single set gillnet may not exceed 50 fathoms in length. The buoys must be marked as specified in 5 AAC 06.334 and 5 AAC 39.280 with both of the CFEC permit holder's five digit permit numbers followed by the letter "D".  In addition, at least one cork every 10 fathoms along the cork line must be plainly and legibly marked with both CFEC permit numbers.  All identifiers must be displayed in a manner that is plainly visible, unobscured, and in a color that contrasts with the background.

 

ISSUE:  Whether to allow set gillnet permit stacking in selected districts of Bristol Bay.

 

WHAT WILL HAPPEN IF NOTHING IS DONE?  Set gillnet permit stacking will not be allowed in Bristol Bay.  This may allow new participants to enter the fishery as multiple permit holders divest.  However, it may also increase difficulty for families to retain possession of permits as family members leave and re-enter the fishery in response to changing circumstances.

 

WILL THE QUALITY OF THE RESOURCE HARVESTED OR PRODUCTS PRODUCED BE IMPROVED?  No.

 

WHO IS LIKELY TO BENEFIT?  Set gillnet fishermen who are able to own and fish two permits.

 

WHO IS LIKELY TO SUFFER?  Unknown.

 

OTHER SOLUTIONS CONSIDERED?  The board considered repealing the sunset clause for this regulation at the December 2012 meeting in Naknek and subsequently voted to allow the regulation to sunset.

NOTICE OF PUBLIC MEETING OF THE

ALASKA BOARD OF GAME

 

The Alaska Board of Game (board) will conduct a one-day meeting on Thursday, January 10, 2013, at Harrigan Centennial Hall located at 330 Harbor Drive, Sitka, Alaska, beginning at 9:00 am.  The meeting is in addition to the Southeast Region meeting which is scheduled to begin January 11, 2013, also at the Harrigan Centennial Hall.  No regulatory action will be taken at the January 10th meeting.

Agenda topics for the one day meeting include:  election of officers; approval of the 2013/2014 Board meeting schedule; informational reports provided by the Department of Fish and Game; a report from the Big Game Commercial Services Board concerning issues of over-lapping jurisdiction with the Board of Game; and a discussion on the moratorium on accepting proposals relating to the Denali wolf buffer zone.

REGULATIONS OF THE ALASKA BOARD OF GAME

 

The Alaska Board of Game proposes to adopt regulation changes in Title 5 of the Alaska Administrative Code, dealing with the use and taking of game.  Regulations subject to board action are in 5 AAC 84, 85, 92, 98 and 99 for the Southeast, Southcentral, and Central/Southwest Regions including statewide reauthorization of antlerless moose hunts and brown bear tag fee exemptions.  The board will also address additional topics for other Game Management Units and statewide provisions as described below:

 

For the Southeast Region, Game Management Units 1, 2, 3, 4 and 5, the Southcentral Region, Game Management Units 6, 7, 8, 14C, and 15, and the Central/Southwest Region, Game Management Units 9, 10, 11, 13, 14A, 14B, 16, and 17, the following subject matter areas to be addressed are:

 

A.  TRAPPING SEASONS AND BAG LIMITS for furbearers, including but not limited to: beaver, coyote, mink, marten, otter, muskrat, squirrel, fisher, marmot, fox, weasel, lynx, black bear, and wolves. 

 

B.  HUNTING SEASONS AND BAG LIMITS for all species including, but not limited to: bison, elk, moose, goat, caribou, black bear, brown bear, deer, Dall sheep, wolves, wolverine, lynx, fur animals, small game, unclassified game, and deleterious exotic wildlife.  In addition, the potential for Tier I or Tier II subsistence hunting for each population; the reauthorization of antlerless moose hunts, and the definition of legal moose antlers for Units 1 and 3.

 

C.  LICENSES, HARVEST TICKETS, HARVEST REPORTS, TAGS, FEES, AND PERMITS including, but not limited to: discretionary and required permit hunt conditions and procedures; discretionary trapping permit conditions and procedures; reauthorization of brown bear tag fee exemptions statewide; special provisions for moose, brown bear, and Dall sheep hunts; permits for hunting black bear and brown bear with the use of bait or scent lures; guide requirements for nonresidents; youth hunts; second degree kindred permit allocation; and community subsistence harvest hunts, areas and conditions including the Copper Basin subsistence harvest hunt which includes Unit 12 and restrictions for hunting in other Game Management Units. 

 

D. HUNTING AND TRAPPING METHODS AND MEANS including, but not limited to: lawful methods of taking game, big game, and furbearers; and use of motorized vehicles for hunting and trapping.

 

E.   POSSESSION, TRANSPORTATION, AND USE OF GAME including, but not limited to:  Restrictions to bag limits; evidence of sex and identity; destruction of trophy value; sealing and salvage requirements; and purchase and sale of game and parts of game.

 

F.   RESTRICTED AREAS including, but not limited to: areas closed to hunting and trapping including the Palmer Creek/Lower Resurrection Creek closed area, and a new closed area in Unit 13 near Denali National Park to taking wolves; closures and restrictions in state game refuges; management areas; and restrictions for use of motorized vehicles in controlled use areas including the Lower Kenai Controlled Use Area; a new controlled use area for the Lindenberg Peninsula.

 

G. INTENSIVE / PREDATOR MANAGEMENT for all prey populations and populations having a positive finding as identified big game prey populations including predation control areas

 

 

 

implementation plans for Units 9, 13, 11, 16, 15; bear snaring in predation control areas; habitat manipulation; population and harvest objections; and related findings.

 

H.  CUSTOMARY AND TRADITIONAL USES OF GAME POPULATIONS including but not limited to: amounts reasonably necessary for subsistence uses for game including wolves.

 

I.    STATEWIDE AND OTHER PROVISIONS:  Seasons and bag limits for caribou in Units 18 and 19; Unit 12 for the Copper Basin community subsistence harvest hunt area and conditions; intensive management for Unit 12; youth hunts for Unit 20; restrictions on the use of pack animals for big game hunting; reauthorization of antlerless moose hunts in all Units, statewide; and the definition for body gripping style of trap.

You may comment on the proposed regulations, including the potential costs to private persons of complying with the proposed changes by submitting written comments limited to no more than 100 single sided or 50 double sided pages to the Alaska Board of Game, Boards Support Section at P.O. Box 115526, Juneau, AK 99811-5526, or by fax to (907) 465-6094, so that comments are received no later than two weeks prior to the meeting during which the topic will be considered. 

 

Unless otherwise specified for a particular meeting in a published notice, written public comments over 100 single sided or 50 double sided pages in length from any one individual or group related to proposals at any one meeting will not be accepted.  Written comments limited to 10 single sided or 5 double sided pages in length from any one individual or group will be accepted after the two-week deadline, but will not be inserted in the board member workbooks until the beginning of the meeting.  Written comments may be submitted to the Board of Game at any time before the proposal is taken up by the board in deliberations, but as a practical matter, written comments should be submitted to the Boards Support Section office at the above address or fax number by the two-week comment deadline to ensure inclusion in the board workbooks.  During the meeting written comments from any one individual or group may be submitted by hand delivery if 20 copies are provided.  Written comments that are submitted are public record and are subject to public inspection. 

 

Each meeting will start at 8:30 a.m. on the first day of the meeting dates noted below.  The public hearing portions for each meeting will begin immediately after staff reports and continue until everyone who has signed up and is present when called has been given the opportunity to be heard.  However, state advisory committee representatives may elect to provide testimony at a later portion of the meetings.  Additional public hearings may be held throughout the meeting just before consideration and adoption of proposed changes in the regulations. The board will take oral testimony only from those who register before the cut-off time announced by the board chair at each regulator meeting.  The length of oral statements may be limited to three to five minutes, or less.  Anyone interested in, or affected by, the subject matter contained in this legal notice should make written or oral comments if they wish to have their views considered by the board.

A.  In the commercial, sport, guided sport, personal use, and aquatic plant fisheries:  fishing seasons, periods, opening and closing times; bag, possession, size, sex, and harvest limits, harvest levels, thresholds or quotas; bycatch provisions; districts, subdistricts, sections, subsections, areas, and other management boundaries; locations open and closed to fishing; methods and means; gear and vessel restrictions, marking, definitions, operational requirements and limitations, registration and permit requirements; registration areas (including exclusive and super exclusive registration areas), permits, harvest record, harvest marking requirements; management plans for conservation, development and allocation among beneficial uses; guiding principles; require, restrict or prohibit the retention, tendering, sale, release, or purchase of fish; methods of release; registration and reporting requirements for fish guides, guided anglers, catchers, processors, buyers and transporters; onboard observer requirements; fish storage and inspection requirements.

 

B.  In the subsistence fisheries (finfish):  identify subsistence uses and users; fishing seasons, periods, opening and closing times, harvest levels; methods and means; size, age, and sex limitations; districts, subdistricts, sections, subsections, areas, and other management boundaries; locations open and closed to fishing; gear and vessel restrictions and operational requirements; harvest limits, registration and permit requirements, requirements for marking and possession of fish; management plans for conservation, development and allocation among beneficial uses, and users; identify customary and traditional uses of fish stocks, determine amounts reasonably necessary for subsistence uses, and establish, change or adjust subsistence and personal use fisheries.

The Alaska Board of Fisheries (board) will conduct a two-day Work Session beginning at 8:30 a.m., October 9-10, 2012, at the Egan Civic and Convention Center as 555 West 5th Avenue, Anchorage, Alaska.  No regulatory action will be taken at this meeting.  Agenda topics include:  election of officers; agenda change requests; petitions; meeting organization and establishment of committees for 2012/2013 cycle; informational reports and/or administrative issues that may come before the board. 

 

After the conclusion of the Work Session, beginning at 8:30 a.m. on October 11, 2012, the board will then be presented with a report on the Western Alaska Salmon Stock Identification Project (WASSIP) by the Alaska Department of Fish and Game.  The purpose of this presentation is to provide the board with the most updated information to assist them with board decisions for the 2012/2013 cycle.

SITKA SOUND HERRING FISHERY UPDATE #2
The department conducted an aerial survey this morning covering Sitka Sound, and areas south to Redoubt Bay and north to Salisbury Sound. Spotting conditions were good with light winds. No herring were seen during the survey. Herring predators continue to be scattered throughout the northern areas of Sitka Sound. Approximately 280 sea lions and 23 whales where seen during the survey with the highest concentrations seen near Old Sitka Rocks and to the north along the Lisianski Peninsula. Ten whales were seen scattered in the area from Guide Island to Vitskari Rocks and one whale was seen near Makhnati Island. Approximately 30 sea lions were seen between Kasiana Island and the Parker Group.

South of Sitka there were few herring predators observed except for approximately 40 sea lions seen in Silver Bay. The next aerial survey is scheduled for Wednesday, March 21.
No roe test samples have been taken to date. This afternoon, a seine boat was on the grounds and prepared to take make a test set, however, the herring were holding in deeper waters and unavailable to seine gear. The department will be seeking another effort to obtain a test sample tomorrow.

The department plans to dispatch the R/V Kestrel from Petersburg to Sitka when roe samples indicate the need to put the fishery on 2-hour notice. A pre-fishery organizational meeting will occur no later than March 25 and may be scheduled earlier if the fishery is placed on 2-hour notice before then.

Permit holders wanting to make practice sets may do so in the deeper waters of Eastern Channel south of Jamestown Bay.

The parallel Pacific cod season in the Cook Inlet Management Area will close to vessels greater
than or equal to 50 feet in length using longline gear effective 12:00 noon March 20, 2012.
This coincides with the National Marine Fisheries Service (NMFS) closure of the Pacific cod
catcher vessel greater than or equal to 50 foot hook-and-line gear sector in the federal Central
Gulf of Alaska area. The parallel season is now closed to all gear types.
Fishermen are reminded that there is a 24-hour delivery time requirement following closure of a
groundfish fishery.

troll gear will be delayed for 24 hours.

If the NWS forecast issued at 4:00 a.m. Tuesday March 20, 2012 for Area 155 contains gale
warnings the season will be delayed for an additional 24 hours. Season opening delays may
continue on a rolling basis for 7 days beyond the initial opening date.

conduct golden king crab research activities in the Aleutian Islands (Registration Area ‘O’)
during the summer of 2012. The Aleutian Islands golden king crab charter will take place
between approximately July 1 and August 6, 2012 and will require a longline crab-pot vessel
115’ or greater in overall length. The charter will begin and end in Dutch Harbor, Alaska.

DEMERSAL SHELF ROCKFISH FISHERY ANNOUNCEMENT
Sitka. . . The Alaska Department of Fish and Game announced today that the directed fishery for
demersal shelf rockfish (DSR) will close in the East Yakutat (EYKT) Section at 4:00 p.m. on Monday,
March 12, 2012. The allocation for the directed DSR fishery in EYKT is 81,144 round lb (36.8 metric
tons). Over 68,000 lb have been taken in this fishery and it is estimated that the remainder of the quota
will be taken at the time of the closure.
The directed DSR fishery remains open in the Southern Southeast Outside (SSEO) Section and the
Northern Southeast Inside (NSEI) and Southern Southeast Inside (SSEI) Subdistricts. These areas will
remain open until allocations are taken or until 4:00 p.m. on March 16, whichever occurs first. Catch and
effort will be closely monitored and area closures may occur on short notice. Closures will be announced
by news release and on the United States Coast Guard “Notice to Mariners” report and the National
Weather Service broadcast. Updates of area closures will also be available on the Groundfish Hotline at
907-747-4882.
For additional information regarding the 2012 directed DSR fishery, refer to the ADF&G news releases
issued on December 30, 2011 and January 27, 2012.

The directed black rockfish jig fishery in the Northeast District of the Kodiak Area will close at
11:59 p.m. on Friday, March 9, 2012. Catch reports indicate total black rockfish harvest is
approaching the Northeast District guideline harvest level.
Following the closure, jig vessels may retain black rockfish in the Northeast District as bycatch,
up to 20 percent by weight of the target species onboard. All other gear types may retain black
rockfish as bycatch, up to 5 percent by weight of the target species onboard. Jig vessel operators
must contact ADF&G in Kodiak by phone or in person to change district registration.
